General Term and Conditions of GuitarSupplies

Article 1. General
1.1 Unless agreed otherwise, these general terms and conditions apply to all offers, orders and agreements with GuitarSupplies. If requested we can send you these terms and conditions free of charge. These terms and conditions are also available for download on our website http://www.guitarsupplies.nl.
1.2 By accepting an offer or when placing an order you will automatically accept these terms and conditions.
1.3 From all definitions that are defined in these terms and conditions can only be deviated in writing. In case of adjustment of a definition all other definitions will still apply.
Article 2. Offers / Agreements
2.1 Any offer made by GuitarSupplies is without engagement, mistakes and technical changes reserved. GuitarSupplies explicitly keeps the right to change prices.
2.2 Agreements are concluded by the acceptance by GuitarSupplies of a written order or subscription request placed by the customer. The customer accepts these terms and conditions by placing its order or subscription request. An order or subscription request is deemed to be accepted by GuitarSupplies if and when GuitarSupplies has not rejected the order or subscription request within ten days of receipt of the order or subscription request.
Article 3. Prices and Payments
3.1 Prices in the shop are in Euro including Dutch VAT and ex handling- and shipment costs, taxes or other fees, accept otherwise shown or agreed in writing.
3.2 Payment is based on pre-payment by bank transfer, accept otherwise agreed. The date of payment is the date of which the bank account of GuitarSupplies is credited. Shipment costs are on the account of the customer.
3.3 In case of non or untimely payment, GuitarSupplies is allowed to postpone or adjourn the agreement.
3.4 For special orders GuitarSupplies is allowed to ask for a written order and a down payment or full pre-payment before accepting the order.
Article 4. Delivery
4.1 The delivery time depends on the stock situation and the country of origin. Due to these facts, delivery times for some articles can vary strongly. Orders will be shipped by TNT or DPD. Shipment will be within 3 to 5 working days upon receipt of the full payment. GuitarSupplies doesn't have a minimum order amount.
4.2 When a shipment is not accepted by the customer - regardless of the reason of rejecting - € 15,- handling costs and the shipment costs will be billed to the customer.
Article 5. Complaints and Returns
5.1 The customer is obligated to inspect the supplied parts directly upon receipt. Possible defects need to be reported, motivated and in writing, to GuitarSupplies within one week of receipt.
5.2 Based on the law Sales on distance, the buyer has the right to return the products, no questions asked. When the products and pacakaging is returned undamaged, Guitarsupplied will give a full refund, with exception of the shipping costs. Shipping costs for the return shipment are on the account of the buyer.
5.2 When it is clear that the products do not comply to the agreement, GuitarSupplies has the choice to replace the products (after receiving the disapproved products) by new ones or to refund the parts including the shipment costs. Return shipments will only be accepted when the as well the products as the packaging are undamaged.
5.3 Return shipments that are not, incorrect or insufficient stamped, will not be accepted by GuitarSupplies.
5.4 Special orders can not be returned. This will be indicated by GuitarSupplies before acceptance of the order.
Article 6. Orders / Communication
6.1 Misunderstanding, malformation, delays or miscommunication due to the usage of internet or any other way of communication between the customer and GuitarSupplies or between GuitarSupplies and third parties in relation to the customer and GuitarSupplies, GuitarSupplies can not be held responsible. Unless bad intention or neglect is proved.
Article 7. Circumstances Beyond Control
7.1 Unabated her other rights, GuitarSupplies has, in case of circumstances beyond her control, the right to postpone the agreement or to adjourn the agreement without interference of a legal court, by reporting the customer in writing and without the obligation to any compensation, unless this, in the given circumstances to the measure of reasonableness, would be unacceptable.
7.2. Circumstances beyond control are defined as every shortcoming that can not be imputed to GuitarSupplies.
Article 8. Sundries
8.1 When GuitarSupplies during a short or longer period in time, whether or not in preserved silence, accepts deviations in these terms and conditions, she still has the right to demand direct and strict observance of these terms and conditions. The customer can never base a complaint by the fact that GuitarSupplies is applying these terms and conditions in a flexible way.
8.2 GuitarSupplies carries a warranty period of 1 year, with exception of consumer products like e.g. strings. There is also no warranty on active and passive electronic parts like e.g. capacitors or semiconductors.
Article 9. Disputes and Applicable law
9.1 To all rights, obligations, offers, orders and agreements to which these terms and conditions apply, as well as these terms and condition, are exclusively subject to the Netherlands law.
9.2 All disputes between parties will be brought before a competent court in the Netherlands
9.3 In the event of disputes concerning the interpretation of these general terms and conditions, the Dutch text shall take precedence.
